Can CBD Flower Be Mailed to You? – List of State Laws

Can CBD flower be sent in the mail? The short answer may seem simple, but in this article we’ll go in-depth with everything you need to know.

Yes, CBD flower can be mailed to you in most states of the U.S. However, while CBD is legal at the federal level, some individual states still have state-wide bans or limitations on CBD. You cannot mail CBD in:

  • Idaho
  • Indiana
  • Kentucky
  • South Dakota

Because CBD is federally legal, CBD flower and other CBD products can even be mailed across state borders. You will only run into trouble mailing hemp flower in states where the use of hemp is limited. 

Although CBD is federally legal, once you get into specifics, what is allowed gets murky. And you don’t want to mess it up and risk trouble on a drug test or even legal problems.

Can you send CBD flower through the mail?

The short answer to this question is yes, it is possible to send or receive CBD flower through the mail. However, depending on where you live and what sort of products you’re hoping to send, things may become a little more nuanced.

Thanks to the 2018 Farm Bill, which legalized the production and use of hemp (and hemp-derived products) at the federal level, it’s possible to purchase CBD products online and have them shipped to your home.

It’s also possible to ship various forms of hemp or hemp-derived products, like seeds, oils, and more. 

Though it may be legal at the federal level, states still have the opportunity to take local regulation and legality into their own hands. As a result, some states still have laws prohibiting the production or sale of hemp, including hemp-derived CBD products. 

As of now, the following states prohibit the production and use of hemp/CBD products:

  • Idaho
  • Indiana
  • Kentucky
  • South Dakota

Mailing Policies

So, if it’s legal to ship CBD flower or other CBD products, how does one go about doing so?

If online shopping for products is your main concern, then you don’t need to worry about the legality of your purchase; as stated above, it’s completely legal to buy online and have your products shipped through the mail.

Those who are concerned about shipping products to other individuals or locations also shouldn’t worry. In the U.S., major mailing service providers all have comprehensive and hemp-friendly shipment policies.

It’s important to note that the mailing of products containing THC (even in states where THC is legal recreationally) is still prohibited. Though states may allow the production and sale of these products, their use is still banned at the federal level. 

Different shipment providers may have different rules and regulations surrounding CBD flower, but in general, you shouldn’t expect to run into any issues. CBD is not viewed as an illicit substance like marijuana is; you can think of it like many other medicinally beneficial products on the market.

Still, it’s a good idea to have a thorough understanding of what shipment may look like within the U.S., so let’s break it down into more detail.

United States Postal Service (USPS)

One of the most commonly used mailing services in the U.S. is, of course, the USPS. Fortunately, the legal status of CBD at the federal level has led the USPS to release clear policy updates regarding the shipment of these products. 

So long as the product in question comes from hemp (including CBD products) plants that contain little to no THC (.03% or below), it can be shipped via the USPS. 

Most controlled substances (including marijuana) are completely prohibited from shipping under USPS policies. However, because hemp is legal at the federal level and does not produce psychoactive effects, there’s no problem. You shouldn’t be concerned about the legality of sending or receiving a package with CBD flower in the mail, for example. 

United Parcel Service (UPS)

Much like the USPS, the UPS follows federal regulations surrounding the shipment of CBD and other hemp products. Legally grown and processed hemp and CBD products can be mailed nationwide.

Something to note is that the UPS does not accept shipments of hemp products from any location that sells marijuana or marijuana products. This is only a minor issue, though – there are plenty of retailers that exclusively sell hemp or CBD products, especially since marijuana is still illegal at the federal level.

Another general note: be careful about sources when buying hemp. Because the market is relatively new, there are still many untrustworthy products out there, including mislabeled hemp. Check out our online directory to find the most exclusive, trustworthy sources. 

FedEx

FedEx is one of the few major mailing services that flat-out prohibits the shipment of hemp and CBD products. Even CBD products that are legal to purchase commercially apply.

The company’s policies ban both marijuana products and products containing CBD, even if the latter is legally purchased. Those who do choose to try to use FedEx to ship CBD products may be subject to both monetary and legal trouble. 

Whether or not FedEx will update its policy on CBD to match other major mailing services is currently unclear. For the time being, though, try to stick to those listed above.

Can CBD flower be shipped across state lines?

Yes, CBD flower can be legally shipped across state lines (once again, thanks to the 2018 Farm Bill!). As long as the product you’re purchasing follows federal guidelines – that is, all CBD products must be derived from hemp containing 0.3% THC or less – you’re in the clear. 

It’s key to remember, though, that the use and possession of CBD and hemp products is illegal in the states we’ve discussed above. To reiterate, the states in which CBD is illegal are Idaho, Iowa, and South Dakota. So, if you live in a state with tight laws surrounding hemp and still purchase products online anyway, you may still be liable to charges or other penalties at the state level.

Can you ship CBD flower internationally?

Laws in the U.S. can be confusing enough, but things can get a little more complicated when it comes to internationally shipping CBD products. 

As we’ve discussed, it isn’t illegal to ship CBD flower or other products in the U.S., and this applies to international shipments as well. However, there are a few things to keep in mind.

First, and perhaps most importantly, is the legality of CBD flower in the location you’d like to ship to. Some countries may still regulate or prohibit the use of hemp and hemp-derived products, so it’s never a bad idea to double-check.

Also important is the fact that international guidelines for what classifies as legal CBD products may differ. Other countries may be more strict about the amount of THC allowed in a product, if any at all.

In order to ship products internationally, for instance, the U.S. requires that the hemp in question must contain 0.2% THC (.1% lower than the domestic level) or less. That means you won’t have any trouble sending products that meet that criteria, but you could still run into problems if those standards are different in the country you’re sending to.

Some countries may flat out ban the recreational use of CBD flower, and some may offer access to these products under the control and supervision of a healthcare professional. It depends on the place you’re looking to ship to; as far as the U.S. side of the process goes, following the legal limits and guidelines is all you need to worry about.
